What is 6(d) certificate?
Massachusetts's statement from a condominium association that no common expense assessments are unpaid on a unit, named for Section 6(d) of the condominium statute. Recorded with the deed at sale.
Also called Massachusetts 6(d) certificate, 6D certificate.
In Havn
Havn prepares the 6(d) certificate from the ledger and the broader package from the record.
Massachusetts resale rulesUnder M.G.L. c. 183A, Section 6(d), a buyer's title is free of the association's lien for unpaid common charges once the association's certificate stating that none are owed is recorded with the deed. Lenders and closing attorneys require it, and the association must furnish it on request within the statute's time.
The certificate is signed by the trustees or the managing agent and usually accompanies a broader resale package the statute does not itself require.
