How Much Can an HOA Charge for a Resale Certificate?

13 states set a dollar cap on the fee. The lowest is Wisconsin at $50 and the highest is Arizona at $400.

Idaho allows no fee at all.

36 states and the District of Columbia set a delivery deadline, most often 10 days.

The shortest is Georgia at 5 business days. The longest is 30 days, under one act each in Alabama, Hawaii, and Illinois.

20 states and the District of Columbia give the buyer a window to cancel after receiving the document.

Only seven states price a rush fee. Everywhere else the cap covers rush service or the statute is silent.

How Long Does an HOA Have to Provide a Resale Certificate?

It depends on the state. 36 states and the District of Columbia set a deadline by statute, most often 10 days from the request. Georgia is the shortest at 5 business days, and 30 days is the longest. Where no statute sets a deadline, the closing date sets the pace, and a late document delays the closing.

What Is an Estoppel Fee?

It is what a Florida association or its management company charges to prepare an estoppel certificate, Florida's name for the signed statement of what a home owes the association. Florida caps it at $299, with $119 more for delivery within 3 business days, and up to $179 more on a delinquent account.

What Is an HOA Transfer Fee, and Is It the Same as a Resale Certificate Fee?

No. An HOA transfer fee is what the association or its management company charges when a home changes hands, to cover updating the ownership records and the new owner's account. It comes from the governing documents or the management contract and is usually collected at closing. It is separate from the fee for preparing the resale document, and it is not in this table. The resale document usually states the transfer fee, so the closing agent knows to collect it.

Who Pays the Resale Certificate Fee?

Whoever orders the document pays the association's fee, usually the seller or the closing agent on the seller's behalf, and the purchase contract can move the cost to the buyer. Illinois's condominium statute lets the association charge the unit seller. In Arizona and New Mexico the fee is collected at the close of escrow.

Can an HOA Charge a Rush Fee?

Seven states price one: Arizona ($100 more, within 3 days), Connecticut ($10 more, within 3 business days), Florida ($119 more, within 3 business days), Illinois ($100 more, within 3 days), Maryland ($100 more, within 7 days), Nevada ($100 more, within 3 business days), and Virginia ($70.66 more, within 5 business days). In Delaware, New Mexico, Rhode Island, Texas, Washington, and Wisconsin the cap covers everything where it applies, so nothing goes on top. Idaho allows no fee at all. Elsewhere the statute is silent, and the association sets its own rush terms.

Where do these figures come from?

Each figure is read from the statute linked in its row, and held in the same reviewed rules Havn applies to every order. Virginia's figures are the current maximums its Common Interest Community Board publishes.

What does a blank cell mean?

Nothing is left blank. A cell says what the statute does, so it reads No dollar cap, No fee allowed, None set by statute, Not set by statute, Nothing on top of the cap, or None tied to this document.

Why do some states have more than one governing act?

A state often has one act for condominiums, another for planned communities, and sometimes a newer uniform act for communities created after a certain date. Each sets its own figures. 31 jurisdictions in this table have two or three acts, and the table shows each on its own line.

Does the calculator count holidays?

No. It counts from the day after the request and skips weekends for business days. Legal holidays are not counted, so a holiday can push the real date later.

Is an HOA certification fee the same as a resale certificate fee?

Usually, yes. Closing statements list the charge for the resale document under several names, among them HOA certification fee, resale disclosure fee, and document fee. A transfer fee is a different charge.

Is a fee cap the most a buyer pays at closing?

No. The cap covers preparing and delivering the document. Transfer fees, capital contributions, prepaid assessments, and other closing charges sit outside it and come from the governing documents.
