What is a rental cap?

A limit in the governing documents on how many homes in a community may be rented at once, or for how short a term. It affects owners, buyers, and the community's loan eligibility.

Also called leasing restriction, rental restriction.

In Havn

Havn tracks renters on the unit record, so the rental percentage on a lender questionnaire comes from the roster rather than a guess.

Condo associations

A rental cap is set by the declaration or an amendment to it, so adopting one takes an owner vote. Caps are stated as a number of units or a percentage, often with a waiting list and a hardship exception, and many grandfather owners who were already renting. Minimum lease terms and bans on short-term rentals are related restrictions.

Lenders ask about the rental percentage on every condo questionnaire, because projects with a high share of rentals face tighter loan rules. A buyer who plans to rent needs to know the cap before closing, which is why the resale package discloses it.
