What is CC&Rs?

The recorded declaration that creates the association and binds every home in it: what owners may do with their property, what they owe, and how the community is governed.

Also called covenants, conditions, and restrictions, declaration, declaration of covenants.

In Havn

The declaration, bylaws, and rules are filed in the community's document library, classified on upload, and attached to every resale package and owner portal.

Document management

CC&Rs, the covenants, conditions, and restrictions, are the declaration recorded against the land when a community is created. Because they are recorded, they run with the land: every buyer takes title subject to them whether or not they read them. They set the assessment obligation, the lien that backs it, use restrictions such as leasing, pets, and parking, architectural control, and the association's powers.

In a condominium the equivalent document is the declaration of condominium, which also defines the units, the common elements, and each unit's allocated interest. Amending a declaration takes an owner vote at the threshold it names, often two thirds or more, and the amendment is recorded too.

The CC&Rs sit above the bylaws and the rules. Where they conflict, the declaration controls, and state law controls above all of them.
