What is a governing documents?

The set of documents that govern a community, in rank order: state law, the recorded declaration or CC&Rs, the articles of incorporation, the bylaws, and the board's rules.

In Havn

Havn keeps the governing documents in the community library with versions, so the resale package and the owner portal always carry the current set.

Document management

When two documents disagree, the higher one controls. State statute sits above everything, then the recorded declaration, then the articles that created the corporation, then the bylaws, then the rules and resolutions the board adopts. A plat or survey map and any recorded amendments belong with the declaration.

Buyers receive the governing documents with the resale package, and lenders ask for them with a condo questionnaire. Keeping the current, amended set in one place is most of the work of answering either request.
