What is a rules and regulations?

Day-to-day rules the board adopts under the authority of the declaration: pool hours, parking, trash cans, holiday lights. Easier to change than the CC&Rs, and lower in rank.

In Havn

A violation notice in Havn cites the rule, carries the photo, and follows the notice ladder the state requires before a fine.

Violations and notices

Rules and regulations are adopted by the board, not voted by the owners, so they can be updated at a meeting. They must stay within what the declaration allows: a board can set pool hours because the declaration gives it control of the common areas, but it cannot ban rentals by rule if the declaration permits them.

Most states require notice to owners before a rule takes effect and a fair process before a fine is imposed for breaking one. Rules are usually the document a new owner reads first and the one most violation notices cite.
