What is a super lien?
In roughly twenty states, a slice of the association's assessment lien that takes priority over the first mortgage, usually a set number of months of assessments.
In Havn
The collections ladder in Havn is configured per state, including what the priority amount covers where the state has one.
CollectionsNormally a lender's mortgage, recorded first, outranks the association's lien, so a foreclosure by the bank can wipe out what the association is owed. Super lien statutes give the association priority for a limited amount, typically six months of regular assessments and sometimes collection costs, so that much survives the bank's foreclosure.
The rule changes behavior on both sides: lenders in super lien states tend to pay the association's priority amount to protect their position, and associations have leverage they lack elsewhere. The number of months and what counts toward it vary by state.
