What is HOA lien?

The association's legal claim on a home for unpaid assessments, created by the declaration and, in most states, by statute. It can be recorded and, within limits, foreclosed.

Also called assessment lien.

In Havn

Havn's collections ladder sends the notices the state requires before a lien step and records every letter on the owner's account.

Collections and late payments

When assessments go unpaid, the association's lien attaches to the home. In many states the lien exists automatically under the declaration; recording a notice of it puts the world on notice and clears the way for further steps. The lien secures the assessments plus the late fees, interest, and collection costs the governing documents and the statute allow.

Foreclosing on an assessment lien is possible in most states but tightly regulated: minimum amounts or months of delinquency, notice and payment plan requirements, and in some states court approval. A lien is paid off at sale through the closing demand.
